Such a law is needed, if it is, precisely because employers who do not automatically grant maternity leave enjoy a competi tive advantage over those who do, and will act to gain that advantage if not forbidden by law. There is of course no logical link between feminism and advocacy of state intervention. Just as a libertarian can consistently regret the failure of private action to secure the advantages of a lighthouse, all the while insist ing that construction of a lighthouse exceeds the bounds of permissible state action, so a libertarian feminist can consistently hold sex roles to be unjust artifacts while insisting that the co-ordinating mechanisms needed to elim inate sex roles—such as mandatory maternity leave—exceed the bounds of permissible state action.

A specific task may be considered male in one society and female in another, but it always enjoys higher status when it is male. A second refinement, or perhaps gap that needs filling, concerns the pro cess by which sex roles have come to be assigned. Many feminists treat the present order as a male conspiracy. Others, who recognize the unlikelihood of a universal conspiracy, argue that sex stereotypes perpetuate themselves: Each generation, having been raised to accept conventional sex roles, raises its own children to those same roles.

F o u r of nine positive scores from the Supreme Court indicates an operational test sensitive to an important social phenomenon. Refinements The four central tenets of feminism must be expanded in a number of ways. First, it must be emphasized that the inequity of the sexual division of labor is said to be two-fold. The horizontal division of tasks into male and female, overlap notwithstanding, largely confines women to domestic tasks while allowing males to do everything else. The vertical division of tasks into subordinate and superordinate reserves for men the topmost posi tions of prestige and authority in all spheres, including those in which men and women participate jointly.
